Terms of Service

These general terms of use (the “Terms”) govern access to the PADEL'EM application for mobile phones and smartwatches (the “App”) and the use of the services provided through it (together, the “Service”). The Terms are supplemented by the Privacy Policy, which explains how personal data is processed.

1. Purpose and acceptance

1.1. The Terms govern the relationship between PADEL'EM and any person who registers with or uses the App (the “User”).

1.2. Registering with or merely using the App constitutes full and unreserved acceptance of the Terms in the version in force at any given time. Users who do not agree with them must refrain from using the Service.

2. Service provider

2.1. The Service is provided by PADEL'EM (“PADEL'EM”, “we” or “us”).

2.2. Users may contact PADEL'EM regarding the Service or the Terms at hello@padelem.com.

3. Description of the Service

3.1. PADEL'EM is an application for iPhone and Android, with companion applications for Wear OS and watchOS watches, designed to record padel matches: score, statistics, heart rate and physical activity.

3.2. The Service also includes social features, leaderboards (the “Rankings”) and artificial intelligence features.

3.3. The Service is offered in a free, ad-supported tier and in a paid tier through the Premium Subscription governed by clause 7.

3.4. The App is not a medical device within the meaning of Regulation (EU) 2017/745 and is not intended for the diagnosis, prevention, monitoring or treatment of any disease or condition.

4. Registration and user account

4.1. An account is required to use the Service. Users must be at least fourteen (14) years old.

4.2. Users may register with an email address or through the Google or Apple sign-in services. Facebook sign-in is no longer available and is only retained on certain accounts created before its withdrawal.

4.3. Users warrant that the information they provide is true and accurate and undertake to keep it up to date.

4.4. Accounts are personal and non-transferable. Only one account per person is permitted, and accounts may not be shared with or assigned to third parties.

4.5. Users are responsible for safeguarding their login credentials and for all activity carried out through their account.

4.6. The device permissions for location, contacts and health data are optional. The only permission required is phone notifications, which is used to sign in on the watch with a QR code. If the User does not grant the location permission, their matches will be recorded but will not count towards the Rankings.

5. Public profile and social features

5.1. Users may set their profile as public or private from the “Edit profile” option. If the profile is public, other Users will be able to see the User's name, photo, city, playing hand, level and statistics, and the User will appear in the Rankings.

5.2. The App allows Users to follow other Users, compare themselves with them, add other players to their matches, whether App Users or persons identified by name only, and look for friends among the device contacts.

5.3. Users undertake to add third parties to their matches only where those persons are aware of it.

6. Rules of use

6.1. Users shall use the Service in accordance with the law, these Terms, good faith and public order.

6.2. In particular, Users shall not:

use the Service in any way that could damage, disable, overload or impair the App or PADEL'EM's systems, or interfere with other Users' normal use of it;
attempt to gain unauthorised access to any service, account, computer system or network connected to the Service;
tamper with the App or its application programming interface (API), or automate requests;
record fake matches or otherwise alter results, as set out in clause 10;
publish unlawful content or content that infringes third-party rights, as set out in clause 11.

7. Premium Subscription

7.1. PADEL'EM is free to use. The paid subscription (the “Premium Subscription”) unlocks advanced features and statistics and removes advertising. The App indicates which features are reserved for the Premium Subscription.

7.2. The Premium Subscription is purchased through Apple's App Store or Google Play (each, a “Store”) and is also governed by the terms of the relevant Store, including those relating to payment, billing, refunds and, where applicable, the right of withdrawal. Refunds are handled by the Store.

7.3. The Premium Subscription renews automatically for successive periods of the same length unless the User cancels it from the Store's subscription settings within the notice period the Store requires (on the App Store, at least twenty-four hours before the end of the current period). Cancellation takes effect at the end of the current subscription period.

7.4. Free trials and introductory offers of the Premium Subscription renew automatically at the price shown unless the User cancels the subscription before they end.

7.5. Codes obtained through the Referral Program and the Rankings grant a Premium Subscription period that ends automatically: they do not start a paid subscription and no charge is made.

7.6. Prices may change in accordance with each Store's rules.

7.7. The Premium Subscription is linked to the User's PADEL'EM account and is managed through the provider RevenueCat.

7.8. If the User is a minor, purchasing the Premium Subscription requires the authorisation of their parents or legal guardians.

8. Referral Program

8.1. Users may invite other people to register with PADEL'EM using their referral code (the “Referral Program”).

8.2. The reward is one (1) month of Premium Subscription and is earned when three (3) people who registered with the User's code have each played three (3) competitive matches of twenty (20) minutes or more within sixty (60) days of registering.

8.3. On iPhone, the reward is delivered as an Apple offer code; on Android, it is applied directly to the account. In both cases it ends automatically and no charge is made.

8.4. PADEL'EM applies anti-fraud controls and will cancel the reward in the event of abuse, in accordance with clause 10.

9. Rankings and prizes: official rules

This clause sets out the official rules governing PADEL'EM's monthly Rankings and the associated prizes. The values shown in the App under “How this ranking works” and “Prizes” form an integral part of these rules.

9.1. Organiser and participation

The Rankings are organised by PADEL'EM. Participation is free of charge.
All Users with a public profile take part automatically. Users with a private profile do not appear in or count towards the Rankings.

9.2. Eligible matches

Only official competitive matches count, excluding matches played in the americano format.
Matches must pass the watch and server integrity checks. Matches that do not pass them are recorded as training.
Matches require the watch location. The location permission is optional: without it, matches are recorded but do not count.
Matches must be synced, and their location resolved, before the month closes.

9.3. Scopes

There are club, region and country Rankings, determined by where the match is played and not by the User's city. The country is the one to which the region where the match was played belongs.

9.4. Standings

Standings are determined by number of wins. In the event of a tie, win percentage applies and, if the tie persists, the User who played most recently ranks higher.

9.5. Period

The Rankings are monthly and calculated in UTC. The App shows the closing time in the User's local time.
There is no grace period: a late sync does not change a month that has already closed.

9.6. Integrity of the competition

Each day, counted in the account's local time, at most eight (8) competitive matches count. Any further matches are recorded as training.
The same match uploaded twice counts only once. If two different competitive matches of the same account overlap in time, both are recorded as training.
Only one account per person is permitted.
Where cheating is detected or suspected, PADEL'EM may cancel results, medals, XP, prizes and codes (including those already redeemed, where technically possible), exclude the account from the Rankings and suspend or block it, without prior notice or compensation, in accordance with clause 10 (Fair play).
Cancelled prizes are not reassigned and closed months are not recalculated.

9.7. Medals and experience points (XP)

Gold, silver and bronze medals award 3,000, 2,000 and 1,000 XP respectively.
Medals are only awarded where the Ranking has at least five (5) participants.
They are cumulative across Rankings: the same User may earn them in their club, region and country in the same month.

9.8. Prize: one-month Premium Subscription code

The code (the “Prize Code”) is awarded to the winner of a region or country Ranking with ten (10) or more participants, provided that they have played six (6) or more competitive matches in that Ranking during the month.
If the winner does not meet this requirement, the Prize Code passes to second place and, failing that, to third place. If no one on the podium meets it, no prize is awarded.
Each person may receive at most one Prize Code per month. If a User wins several Rankings, the Prize Code for the others passes to the next person on the podium. Users may win in different months.
Club Rankings do not award a Prize Code.

9.9. Delivery and redemption of the Prize Code

The Prize Code is sent by email to the address associated with the winner's account, together with a notice in the App. It can be resent from the App, including to a different email address.
It does not expire and may be given to a third party.
It has no cash value and cannot be exchanged for money.
It can only be redeemed on accounts without an active Premium Subscription and at most once every six (6) months per account, from Premium → “Have a code?”.
On iPhone, it is redeemed as an Apple offer code, also subject to Apple's terms, and activates one (1) free month of Premium Subscription that ends automatically, without renewal or any charge.
On Android, it is applied directly to the account for one (1) month, ends automatically and no charge is made.
PADEL'EM may cancel the Prize Code where it is suspected to have been obtained by cheating, as well as the Premium Subscription period obtained with it, where technically possible.

9.10. Other conditions

Apple and Google do not sponsor or take part in this competition. Neither of them endorses or administers it, nor assumes any liability in connection with it.
These rules may only be amended with effect from the following month.
Results of closed months are final, save for the cancellation of an account's results and prizes for cheating, in which case they are not reassigned. There is no claims or manual review procedure; any queries may be sent to hello@padelem.com.

10. Fair play

10.1. Recording fake matches, tampering with the App or its API, automating requests and sharing accounts are prohibited.

10.2. Matches that do not pass the integrity checks are recorded as training.

10.3. Where PADEL'EM detects or has reasonable grounds to suspect cheating, fraud or abuse, it may, at its discretion, having regard to the seriousness of the conduct and without prior notice, take one or more of the following measures:

record matches as training or remove them from the Rankings;
cancel results, positions, medals and XP;
cancel prizes and codes, both pending ones and the Premium Subscription period obtained with them, where technically possible;
exclude the account from the Rankings and prizes;
suspend or block the account, temporarily or permanently.

10.4. These measures do not give rise to any right to compensation. If the User believes an error has been made, they may report it to hello@padelem.com; there is no formal review procedure. This is without prejudice to any rights the User may have under applicable law.

11. User Content

11.1. Users retain ownership of the content they contribute to the Service, such as their photo, their name or their match notes (“User Content”).

11.2. Users grant PADEL'EM a non-exclusive, royalty-free licence, limited to the purpose of providing the Service, to host, reproduce and display User Content within the App, in accordance with their privacy settings and for as long as they keep their account.

11.3. Users warrant that their User Content is lawful and that they hold the necessary rights and permissions, in particular where it includes third parties' data or images, and shall be liable for any damage arising from a breach of this warranty.

11.4. Anyone may notify PADEL'EM of unlawful content on the Service at hello@padelem.com. PADEL'EM may remove content that breaches the law or these Terms.

12. Health and safety

12.1. Processing of health data is optional: the permission is requested on the watch and can be turned off at any time.

12.2. Heart rate, calories and other metrics are estimates obtained by the watch and may not be accurate.

12.3. These metrics are for information purposes only and do not replace medical advice, diagnosis or treatment. Users should exercise responsibly and consult a healthcare professional with any questions about their health.

13. Artificial intelligence features

13.1. The App's chat and analyses are generated by artificial intelligence systems. When using them, the User is interacting with an artificial intelligence system and not with a person.

13.2. Generated answers and analyses may contain errors or inaccuracies, are for guidance only and do not constitute professional advice of any kind.

13.3. Users shall not enter sensitive data, whether their own or third parties', into the chat.

14. Advertising

14.1. The free tier of the Service displays advertising, including rewarded ads.

14.2. The Premium Subscription removes advertising.

14.3. Personalised advertising requires the User's consent, as described in the Privacy Policy.

15. Intellectual and industrial property

15.1. The App and its content, including text, images, logos, distinctive signs, design and software, belong to PADEL'EM or its licensors and are protected by Spanish and international intellectual and industrial property laws.

15.2. PADEL'EM grants Users a personal, non-exclusive, non-transferable, revocable licence to use the App, limited to private and non-commercial use, for as long as their account remains active.

15.3. Reproduction, distribution, public communication, transformation or any other exploitation of the App or its content without PADEL'EM's express authorisation is prohibited, as is decompiling or reverse engineering the software, except where expressly permitted by law.

16. Availability and changes to the Service

16.1. PADEL'EM may modify, extend, restrict or discontinue features of the Service. Where a change negatively affects access to or use of the Premium Subscription in a more than minor way, the User will be informed reasonably in advance and may terminate the contract as provided for in consumer protection law.

16.2. PADEL'EM does not guarantee uninterrupted availability of the Service, which may be temporarily suspended for maintenance, updates or reasons beyond its control.

16.3. Ranking rules only change with effect from the following month.

17. Liability

17.1. To the fullest extent permitted by applicable law, PADEL'EM shall not be liable for any loss or damage arising from the use of the Service, from errors in the metrics or in answers generated by artificial intelligence, or from interruptions or failures of the Service.

17.2. PADEL'EM shall not be liable for any use of the Service contrary to these Terms, or for the content, policies or practices of third-party sites and services accessed through links.

17.3. Nothing in these Terms excludes or limits PADEL'EM's liability where the law does not permit it, in particular for wilful misconduct, gross negligence or personal injury, nor the rights granted to the User by consumer protection law.

18. Term, account closure and suspension

18.1. The Terms remain in force for as long as the User keeps their account.

18.2. Users may close their account at any time by deleting it from the App. Deleting the account does not cancel a Premium Subscription purchased in a Store, which must be cancelled from that Store. What happens to the User's data and Ranking results is described in the Privacy Policy.

18.3. PADEL'EM may suspend or block access to the Service, temporarily or permanently, if the User breaches these Terms, without prejudice to the measures provided for in clause 10.

19. Data protection

The processing of the User's personal data is governed by the Privacy Policy, which sets out the purposes, legal bases, recipients, retention periods and how to exercise data protection rights.

20. Changes to the Terms

20.1. PADEL'EM may amend these Terms to reflect changes in the law, changes to the Service or operational needs.

20.2. Material changes will be notified at least thirty (30) days before they take effect. Users who do not agree may delete their account before that date; continued use of the Service after it constitutes acceptance of the amended Terms.

20.3. The date of the current version is shown at the top of this document.

21. General provisions

21.1. If any provision of these Terms is held to be void or unenforceable, in whole or in part, only that provision shall be affected, and the remaining provisions shall remain in full force and effect.

21.2. PADEL'EM's failure to exercise any right under these Terms shall not constitute a waiver of that right.

21.3. These Terms are available in Spanish and English. In the event of any discrepancy between the two versions, the Spanish version shall prevail.

22. Governing law and jurisdiction

22.1. These Terms are governed by Spanish law, without prejudice to the mandatory consumer protection rules of the User's country of habitual residence.

22.2. Any dispute shall be submitted to the courts having jurisdiction under applicable law. Where the User is a consumer, the courts of their place of domicile shall have jurisdiction.
